These terms and conditions apply to the services which we may provide you through our platform located here, https://quote.gotogroup.co.uk

Please read all of these terms and conditions carefully before you order services from us because, by ordering, you agree to be bound by them. Each time you place an order you will be asked to agree to these terms and conditions. If you do not accept these terms and conditions, you should not order any services from us.

You can print a copy of these terms and conditions by selecting the "Print" option from the "File" menu of your browser.

Please note that the use of this platform is subject to the terms contained in our Website Terms and Conditions of Use, which apply whether or not you order services from our platform.

Information about us and how to contact us

Who we are In these terms and conditions "we", "us" or "our" refers to Genle Ltd T/A GOTO Mortgages, a company registered in England and Wales. Our company registration number is 9790404 and our registered office is at 19-21 Chapel Street, Marlow, SL7 3HN. Our registered VAT number is 227 6331 14.

How we may contact you. If we have to contact you, we may do so by telephone or by writing to you using the telephone number, email address or postal address you provided to us.

How we work

2.1
We are not a broker, but our services will introduce you to a number of mortgage brokers free of charge. If you proceed with a product or service via the mortgage broker which we provide, we will receive a fee or commission from the mortgage broker on conclusion of a mortgage agreement with a lender.

2.2
In order for us to propose mortgage brokers, you will need to provide information about you to us, by answering a number of questions on our platform. We provide a list of mortgage brokers based on the information you provide to us.

2.3
However, we are not under a duty to provide information, advice, or recommendations on an impartial or disinterested basis, and you will be responsible for selecting which mortgage broker you ultimately use – whether proposed through our platform or otherwise.

2.4
All these mortgage brokers are regulated by the Financial Conduct Authority or are "appointed representatives" of firms that are regulated by the Financial Conduct Authority, whom we have introducer agreements with.

How to access our platform

3.1
You can access our platform here.

3.2
As part of the registration process, you will be asked to provide us with information about you. This information will enable to us provide a list of mortgage brokers who are specific to your needs.

3.3
You will be asked to provide us with [your full name, email address, telephone number, address, as well as various property details including your annual income, savings, outstanding debt, buying price and the location of the house relevant to the mortgage].

3.4
You are solely responsible to ensure that all information that you provide to us is true, accurate and complete.

3.5
You are responsible for reading and accepting the terms and conditions of the mortgage broker as they will differ to ours. It is also important that you check your details match those provided to us. You should read all documents issued to you by your selected mortgage broker. If any information is incorrect, it is your responsibility to identify the mistake and correct this with the mortgage broker direct.

3.6
We handle your personal data in accordance with paragraph 7.

4.
Contract restrictions

4.1
Consumers only Our services are only intended for use by consumers (that means people who want to use our services for their personal use and not for any business purposes).

4.2
Restrictions on delivery areas Our platform must only be used by UK residents and nothing in these terms and conditions will constitute as an offer or promotion of services outside of the United Kingdom.

4.3
Confirmation of personal status By placing an order with us through our platform, you are confirming to us that you are a consumer and that you are at least 18 years old.

Complaints

5.1
While we aim to provide the best possible service to you, there may be occasions where you feel we have not achieved this.

5.2
We value any feedback from you, and we take complaints seriously. Please follow this link to read our complaints procedure.

5.3
If your complaint is in relation to the services of the mortgage broker with whom we put you in touch, then you should address your complaint directly to that mortgage broker.

5.4
We cannot accept any liability for errors made by the mortgage broker or answer any complaints on their behalf. We recommend you follow the mortgage broker's complaints procedure in such event.

6.
Our responsibility for loss or damage suffered by you

6.1
We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms and conditions or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable or not caused by us breaking the contract. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew that it might happen, for example, if you discussed this with us during the registration process.

6.2
In no circumstance will we be responsible for any losses which arise in connection with an event or series of events which is/are outside of our reasonable control.

6.3
We do not exclude or limit in any way our liability to you for death or personal injury caused by our negligence, or our responsibility for fraudulent misrepresentation and any other liability that cannot be excluded by law.

6.4
We act as introducers for the brokers. In contracts between the broker and you, we can never be held responsible for the actions of either party or any consequences resulting therefrom.

6.5
We are not liable for business losses. We only supply the services for domestic and private use. If you use the services for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

7.
How we may use your personal information

7.1
How we will use your personal information. We will use the personal information you provide to us:

7.1.1
to provide you with a list of proposed mortgage brokers; and

7.1.2
in accordance with our Privacy Policy

7.2
We will only give your personal information to other third parties where the law either requires or allows us to do so.

8.
Other important terms

8.1
You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

8.2
Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person to end the contract or to make any changes to these terms.

8.3
If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

8.4
Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

8.5
Which laws apply to this contract and where you may bring legal proceedings. You and we agree that English law applies to these terms and that any dispute between us arising out of or in connection with these terms will only be dealt with by the English courts, unless you live in another part of the UK, in which case the applicable law of that part of the UK or Republic of Ireland will apply, and any dispute will be brought before the courts of that part of the UK.

8.6
Alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to contact the alternative dispute resolution provider we use. You can submit a complaint to Customer Service Manager via their website at www.gotogroup.co.uk. The Customer Service Manager will not charge you for making a complaint and if you are not satisfied with the outcome you can still bring legal proceedings.
